Terms of Service

1. Acceptance of Terms

By accessing or using ExamCrafter ("the Service"), operated by Conor Ghobrial ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

ExamCrafter is a SaaS platform that allows users to upload educational materials (PDFs, slides, documents), generate AI-powered exam questions, track study progress, and review performance analytics. The Service is available via web application at https://app.examcrafter.app and as a desktop application.

3. Account Registration

You must create an account and verify your email address to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration. You must be at least 16 years of age to create an account.

4. Subscriptions and Billing

ExamCrafter offers free and paid subscription tiers (Starter, Pro, Graduate, and Finals Pass), billed monthly, annually, or as a one-time purchase where applicable. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are listed on our pricing page and may be updated with 30 days' notice to active subscribers.

5. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. No refunds are provided for subscription plans, including partial billing periods. Finals Pass purchases include a 7-day refund window — if the product is not helping your exam prep, contact us within 7 days of purchase for a full refund. If you believe you were charged in error on any plan, contact us at conor.ghobrial@gmail.com within 14 days.

6. User Content

You retain ownership of all materials you upload to ExamCrafter. By uploading content, you grant us a limited, non-exclusive license to process your materials solely for the purpose of providing the Service (e.g., AI-powered question generation). We do not claim ownership of your uploaded content. You are responsible for ensuring you have the right to upload any materials you provide.

7. AI-Generated Content

Questions, explanations, and other content generated by the AI are provided for educational purposes only. AI-generated content may contain errors or inaccuracies. You should review all generated content before relying on it for academic purposes. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

8. Acceptable Use

You agree NOT to: (a) use ExamCrafter to facilitate academic dishonesty, cheating, or fraud; (b) share generated exam content in violation of your institution's academic integrity policies; (c) upload copyrighted materials without proper authorization; (d) attempt to reverse-engineer, disassemble, or circumvent any security measures of the Service; (e) use the Service for any unlawful purpose; (f) share your account credentials with others or create multiple accounts. Violation of these terms may result in immediate account termination without refund.

9. Intellectual Property

The Service, including its design, code, features, and branding, is the property of Conor Ghobrial and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10. Third-Party Services

ExamCrafter integrates with third-party services including Supabase (hosting), Stripe (payments), Google Gemini and OpenAI (AI generation), and Sentry (error tracking). Your use of these services is subject to their respective terms of service and privacy policies.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONOR GHOBRIAL, OPERATOR OF EXAMCRAFTER, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ACADEMIC CONSEQUENCES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination by contacting us.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules. You agree to waive your right to a jury trial.
